SekaiLens Photoshoot Terms and Conditions

  1. Booking and Payment Terms

    • Deposit: A non-refundable deposit of 50% is required to secure your booking. The remaining balance must be paid on the day of the photoshoot.
    • Full Payment: Clients also have the option to pay the full amount upfront, subject to the same non-refundable terms.
    • Payment Methods: We accept payments via PayID, bank transfer, or cash. For cash payments, a valid ID must be presented for proof of identity.

  2. Session Guidelines & Rescheduling

    • Session Arrival: Please arrive on time for your scheduled session. Late arrivals may result in a shortened session. If availability permits, additional time may be offered at an extra charge (details below).
    • Rescheduling:
      • Rescheduling is permitted up to 48 hours before the session without additional charges, subject to availability.
      • Changes within 48 hours of the session will incur a 20% rescheduling fee, provided there is availability.
      • If rescheduling within 48 hours and no time slot is available, a 50% rescheduling fee will apply.

  3. Photo Selection and Delivery

    • Unedited Photos: Unedited photos will be provided within 1–2 weeks after the photoshoot. Clients may select their preferred images for editing.
    • Selection Deadline: If clients fail to respond within 3 days of receiving the unedited photos, SekaiLens reserves the right to select images on their behalf.
    • Edited Photos Delivery: Edited photos will be delivered within 2–3 weeks after the selection is finalized.
    • Delivery Method: Photos will be shared via a secure online gallery link.

  4. Editing and Revisions

    • Editing Services: Basic editing and color correction are included with all packages. Additional requests for retouching or advanced effects may incur extra fees.
    • Advanced Effects: Intermediate effects are provided based on the chosen package. Heavy visual effects fall outside package inclusions and will incur additional charges.
    • Revisions:
      • Up to 3 rounds of basic revisions and 2 rounds of advanced revisions are included in all packages.
      • Any additional revisions will be charged at an hourly rate.

  5. Usage and Copyright

    • Copyright Ownership: SekaiLens retains full copyright ownership of all images produced. Clients are granted a personal use license.
    • Client Usage: Images may be used for personal purposes, such as social media posts. Commercial use requires a separate license, subject to additional charges.
    • Promotional Use: By booking with SekaiLens, you consent to allow your images to be used for promotional purposes, including social media, portfolios, and marketing materials. If you wish to opt out, please notify us in writing prior to your photoshoot.

  6. Confidentiality

    • Privacy Assurance: All personal information provided by clients will remain confidential and will not be disclosed without explicit consent.

  7. Additional Fees

    • Travel Expenses: Travel fees may apply for sessions held outside predefined locations.
    • Overtime Charges: Additional session time, beyond the agreed duration, will be charged at an hourly rate.
    • Commercial License Fees: Media intended for commercial use, including social media posts with sponsorship or ad revenue, requires a perpetual commercial license priced at twice the total session cost.
    • Damage Responsibility: Clients are liable for damages caused by themselves or their guests to equipment, props, or studio space. Repair or replacement costs will be billed accordingly.

  8. Agreement and Acceptance

    • Consent: By booking a photoshoot with SekaiLens, you acknowledge and agree to these Terms and Conditions.

SekaiLens Focus+ Terms and Conditions

PLEASE READ THESE TERMS CAREFULLY. BY ENROLLING IN THE SEKAILENS FOCUS+ MEMBERSHIP, YOU ("MEMBER") CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE WITH ANY PART OF THESE TERMS, PLEASE DO NOT ENROLL OR USE THE MEMBERSHIP.

1. Membership Overview and Tiers

  • Program Description:
    The SekaiLens Focus+ Membership is designed for photography enthusiasts and is offered in both free and paid tiers. Membership provides access to exclusive benefits, rewards, and enhanced services.
  • Tiers:
  • Free Tier: Offered at no cost.
  • Paid Tier(s): Require payment of the applicable fee (non-refundable unless otherwise stated).

2. Rewards Program

  • Points and Rewards:
    • Members earn digital credits ("Points") that are redeemable for exclusive rewards.
    • Seasonal Rewards Points: Earned during set "seasons" and will reset or expire at the end of the season.
    • Permanent Rewards Points: Accumulate continuously and do not reset.
  • Non-Transferability:
    All Points are non-transferable and have no cash or monetary value. They may only be used for redeeming the rewards provided within the Membership program.

3. Membership Credential and Replacement

  • Credential Issuance:
    Upon registration, members receive a digital or physical credential which is used to track Points and redeem rewards.
  • Replacement Policy:
    If your credential is lost, stolen, or damaged, a replacement may be provided after proper verification—and, where applicable, payment of a replacement fee.

4. Privacy and Data Protection

  • Data Collection and Use:
    We collect personal data (e.g., name, contact details, and usage information) to:
    • Enhance and personalize your Membership experience.
    • Send promotional offers and Membership updates.
    • Facilitate communication and scheduling with photographers and related partners.
  • Consent and Security:
    By enrolling, you consent to our collection, processing, and sharing of your data as described. We use reasonable measures to safeguard your information, although no method is completely secure.
  • Your Rights:
    You may access, update, or request deletion of your personal data, subject to any legal obligations.

5. Promotional Communications

  • Marketing Contact:
    By participating, you agree that we may send you promotional emails, texts, or other communications regarding new offers, updates, or special opportunities.
  • Opt-Out:
    You may unsubscribe from promotional communications via the provided instructions; however, this will not affect your receipt of essential Membership information.

6. No Warranty and Limitation of Liability

  • No Warranty:
    All aspects of the Membership—including Points, Rewards, and overall service availability—are provided on an "as is" basis without any warranty. This includes any guarantee as to the continuous availability, accuracy, or performance of the rewards and services. There is no warranty that the rewards or benefits will always be available or that they will meet your specific requirements.
  • Limitation of Liability:
    To the maximum extent permitted by law, neither the SekaiLens Focus+ team nor any contributors shall be liable for any indirect, incidental, consequential, or punitive damages incurred from your enrollment or use of the Membership. This includes, but is not limited to, loss of revenue, loss of profits, or any other loss arising out of or in connection with your use of the Membership or the inability to obtain rewarded benefits.

7. Indemnification

You agree to indemnify and hold harmless the SekaiLens Focus+ team and its contributors from any claims, damages, or expenses (including reasonable legal fees) arising out of your use of the Membership, any breach of these Terms, or any inaccurate information provided during registration.

8. Amendments, Modifications, and Termination

  • Amendments:
    We may update these Terms at any time. Material changes will be posted on the Membership site at least 3 days before they take effect. Continued use of the Membership implies your acceptance of the new terms.
  • Termination:
    Your Membership may be suspended or terminated by us at any time, with or without cause. Upon termination, all accrued Points and pending rewards will be forfeited without compensation.

9. Dispute Resolution

  • Dispute Resolution:
    Any disputes shall only be resolved through direct negotiation.

10. Entire Agreement

These Terms, together with any referenced policies, constitute the entire agreement regarding your Membership and supersede all prior agreements or communications.

  3. File Responsibility and Damage

    • Once digital files are delivered, clients are solely responsible for safeguarding and backing up their purchased content.
    • SekaiLens Media is not liable for any loss, deletion, or corruption of files caused by the client or third-party services.
    • Replacement files will only be considered in cases where the original delivery contained errors or defects caused by SekaiLens Media.
    • This is subject to the condition that SekaiLens Media still retains the original files at the time of the request. Please note that original files may be deleted after a certain period to free up storage for new projects.

  4. Acceptance of Terms

    • By placing an order through the SekaiLens Media Online Shop, clients confirm that they have read, understood, and agreed to these Terms.
